Practice chair Don Gregory was invited to speak at the Ohio Prosecuting Attorneys Association’s annual meeting on the topic of competitive bidding for public contracts in the construction industry. Don covered the requirements (and exceptions) that are critical for public entities to consider when opening projects for bid, including criteria for (1) advertising requirements, (2) bid selection, (3) bid withdrawal, (4) rebidding and more.
Don also covered the post-selection issues that remain common, from bid protest meetings and litigation to recovery of financial damages stemming from litigation. He closed with a review of the Huntington Ballpark dispute and an overview of the contract and bond forms that have become the industry standard.
